Terms & Conditions of Sale and Use

This document governs the use of services provided by GULF17 Building & Construction Material Trading LLC (hereafter referred to as “GULF17,” “We,” “Us,” or “Our”).

1. Acceptance of Terms

By placing an order for products or services (“Products”) from GULF17, the purchaser (“Customer,” “You,” or “Your”) agrees to be bound by these Terms and Conditions.

2. Products and Services

  • Product Description: We specialize in the trading of veneers, decorative papers, and boards for interior applications (collectively, “Construction Materials”). All descriptions, specifications, and pricing are subject to change without notice.
  • Product Accuracy: We strive to display product colors and finishes as accurately as possible. However, the actual appearance may vary due to monitor settings, natural material variations (especially for veneers), and production batch differences. GULF17 is not responsible for such variations.
  • Samples: All samples are provided solely for demonstration purposes. Variations between samples and the final delivered product may occur.

3. Pricing and Payment

  • Pricing: All prices are quoted in AED [UAE Dirham] and exclude applicable taxes, duties, and shipping costs unless otherwise stated.
  • Payment Terms: Payment terms will be specified on the invoice. We accept Bank Transfer, Card Payments, Tabby (Buy now, Pay Later). Full payment is required before shipping unless a credit account is pre-approved.
  • Late Payment: GULF17 reserves the right to charge interest on overdue amounts at a rate of 2% per month or the highest rate permitted by law.

4. Shipping and Delivery Policy

  • Shipping Area: We ship globally anywhere in the world.
  • Delivery Times: Estimated delivery times are provided upon confirmation of the order and are not guaranteed. Time of delivery is not of the essence in this contract.
  • Risk of Loss: The risk of loss or damage to the Products passes to the Customer upon delivery to the Customer’s nominated carrier or at the point of offloading at the Customer’s designated site.
  • Acceptance: The Customer must inspect the Products immediately upon receipt. Any obvious shortage or damage must be noted on the delivery receipt and reported to GULF17 within 48 hours of delivery. Failure to do so constitutes acceptance of the Products as delivered.

5. Return and Exchange Policy

  • General Materials: Due to the specialized and project-based nature of construction materials, all sales are final once the materials have been cut, installed, or altered in any way.
  • Pre-Installation Returns: Unused, unopened, and non-damaged Products may be eligible for return or exchange within 7 days of delivery, subject to a 20% restocking fee.
  • Condition of Return: Returned Products must be in their original packaging and in a resalable condition. The Customer is responsible for return shipping costs.
  • Custom Orders: Products that are custom-ordered, cut-to-size, or specially manufactured are non-refundable and non-returnable.

6. Warranty Policy

  • Limited Warranty: GULF17 warrants that the Products will be free from defects in material and workmanship under normal use for a period of 5 Year from the date of delivery.
  • Exclusions: This warranty does not cover:
    • Damage resulting from improper storage, handling, installation, or application.
    • Damage caused by misuse, abuse, accidents, or force majeure events.
    • Fading or deterioration due to exposure to direct sunlight, moisture, or extreme temperature variations.
    • Normal wear and tear.
    • Variations in color, grain, or texture inherent to natural materials (veneers).
  • Claim Procedure: To make a warranty claim, the Customer must notify GULF17 in writing immediately upon discovery of the alleged defect, providing proof of purchase and photographs of the defect.
  • Remedy: GULF17’s sole obligation under this warranty is, at its option, to either repair the defective Products, replace the defective Products, or refund the purchase price for the defective Products.

7. Refund Policy

  • Eligibility: Refunds are only provided under the following circumstances:
    • The Product is proven to be defective according to the Warranty Policy.
    • The Product is returned under the Return Policy and is accepted by GULF17, minus any applicable restocking fees.
    • An order is cancelled before shipment and payment has been fully processed.
  • Processing: Approved refunds will be processed within 20 business days to the original method of payment.

8. Limitation of Liability

In no event shall GULF17 be liable for any indirect, incidental, punitive, special, or consequential damages (including, without limitation, loss of profits, revenue, or data) arising out of or in connection with the sale or use of the Products, even if GULF17 has been advised of the possibility of such damages. GULF17’s total liability shall not exceed the purchase price paid by the Customer for the specific Products giving rise to the claim.

9. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Emirate of Dubai and the Federal Laws of the UAE. Any disputes arising shall be subject to the exclusive jurisdiction of the Dubai Courts or ADGM/DIFC Arbitration.
